Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Pracxam Ltd, a company registered in New Zealand ("we", "us", "our"), which operates xametric.com and the Xametric service ("Xametric" or the "Service"). They govern your access to and use of the Service.

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who may use the Service

The Service is intended for students preparing for academic assessments and the parents and guardians supporting them. The Service is used by young people, and minors are able to create accounts. If you are under 18, you should use the Service with the involvement of a parent or guardian, and a parent or guardian is responsible for any subscription and payment made through the account.

By using the Service you confirm that the information you provide is accurate and that you have authority to agree to these Terms (or that a parent or guardian has agreed on your behalf).

2. Accounts

  • You are responsible for keeping your login details secure and for activity that occurs under your account.
  • You must provide accurate information when registering and keep it up to date.
  • Accounts are for a single individual's personal use and must not be shared, sold or transferred.
  • Please tell us promptly at service@xametric.com if you believe your account has been accessed without authorisation.

3. Subscriptions, billing and cancellation

  • Xametric is offered on monthly subscription plans. Current plans and prices are shown on the pricing page in your local currency.
  • Subscriptions are billed in advance and renew automatically each month until cancelled. Payments are processed by Stripe.
  • You may cancel at any time from your account settings. When you cancel, your access continues until the end of the current paid period, and you will not be charged again.
  • We may change our plans or prices from time to time. Any price change will apply from your next billing period after we notify you.
  • Refunds are handled in accordance with our Refund Policy.

4. Acceptable use

You agree not to:

  • copy, reproduce, distribute, resell, or publicly share the questions, worked solutions or other content of the Service;
  • use the Service for any purpose other than personal study and exam preparation;
  • attempt to access the Service or its content through automated means (scraping, bots), or to reverse-engineer, interfere with, or disrupt the Service;
  • share your account or access credentials with others.

5. Our content and intellectual property

All content in the Service — including questions, worked solutions, explanations, tips, and the design of the Service — is owned by or licensed to Xametric and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive licence to access and use the content for your own study while your subscription is active. No other rights are granted.

6. Independence and no affiliation

Xametric provides independent, ICAS-style preparation material. Xametric is not affiliated with, endorsed by, or connected to the providers or owners of ICAS or any other assessment, examination board, or trademark referred to on the Service. Any such names are used only to describe the kind of assessment our material helps prepare for, and remain the property of their respective owners.

7. No guarantee of results

The Service is a study and preparation tool. While we work to provide high-quality, relevant practice material, we do not guarantee any particular exam result, score, or outcome. Your results depend on many factors outside our control.

8. Consumer rights

If you are a consumer, nothing in these Terms limits or excludes rights you have under the New Zealand Consumer Guarantees Act 1993 or, for Australian users, the Australian Consumer Law. Those guarantees apply in addition to these Terms and cannot be contracted out of where the law does not allow.

9. Disclaimers and liability

To the extent permitted by law (and subject to section 8):

  • The Service is provided "as is" and "as available", without warranties beyond those that cannot be excluded by law.
  • We are not liable for indirect, incidental or consequential loss.
  • Where our liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

10. Suspension and termination

We may suspend or terminate access to the Service if you breach these Terms or use the Service in a way that harms Xametric or other users. You may stop using the Service and cancel your subscription at any time.

11. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. When we change the Terms we will update the "Last updated" date, and significant changes will be communicated through the Service where practicable. Continuing to use the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction. Nothing in this section affects mandatory consumer-protection rights available to you in your country of residence.
